Mid-Day Burglary Stopped by Home Owner
A homeowner, aged 68, from New Orleans heard some noises outside his home on Tuesday around 11:30 a.m. Feeling suspicious of the noises, the elderly man armed himself and walked outside.
At that moment, the homeowner (who we will not name to protect his identity) saw a many taking items from his shed.
The homeowner confronted the man who in turn, according to reports, attacked the homeowner and a physical altercation ensued. During the incident, the homeowner was able to fire multiple shots striking the criminal in the stomach, arm and leg.
The victim immediately called the police and the criminal is expected to survive before being charged and sent to prison. At this time there are no charges against the homeowner and the case is being sent over to the DA’s office for further review.
As a reminder, you are not allowed to use deadly force in the protect of property or material possessions. The reason that this case is not classified this way is because the criminal attacked the homeowner who felt that his life was in jeopardy.
Holding someone at gunpoint after trespassing or stealing from you is technically legal, but it is also a grey area to a lot of DA’s and prosecutors. If you ever find yourself in this situation, we recommend calling the police and remaining in a safe area where you are protected.
While it is well within your right to confront someone who is trespassing and stealing from your property, if your life is not immediately in danger and you can remove yourself from the situation and call police we recommend that action. Material possessions can be replaced easily (and are usually covered under you HOI) but when you confront a criminal the chances of injury to you skyrocket.
